Changing the buyer\u2019s jurisdiction or trade terms would not legally allow Belarusian potash transit through Baltic ports to third countries, says an analysis by the Warsaw-based National Anti-Crisis Management (NAM), led by Pavie\u0142 \u0141atu\u0161ka.<\/p>\n\n\n\n

The group based its conclusions on the European Union\u2019s sanctions legislation and case law, noting that the term \u201ctransfer\u201d in EU sanctions regulations refers specifically to the physical transport, carriage or transit of goods across a border or through the territory of the EU under any customs procedure.<\/p>\n\n\n\n

The ban on transfers applies regardless of the goods\u2019 final destination, including shipments between third countries, if an EU operator such as a bank, insurer, shipowner or freight forwarder is involved, even indirectly, in the logistics chain, the NAM said.<\/p>\n\n\n\n

The Alaksandar \u0141uka\u0161enka regime may push for recognizing potash fertilizers as a critical commodity for global food security to use the designation as a political and diplomatic argument to pressure international organizations and Global South countries, NAM lawyers said. However, such a provision would not create a directly applicable legal loophole, they added.<\/p>\n\n\n\n

Last year, the EU General Court threw out Bie\u0142aru\u015bkalij\u2019s appeal against the sanctions. Any attempt to circumvent the ban by selling goods in Belarus on an Ex Works basis, under which a foreign buyer declares the goods as its own property for export, would be legally null and void, according to the NAM.<\/p>\n\n\n\n

The analysis also stressed that EU regulations explicitly prohibit operators from member states, including railways, port terminals, freight forwarders and insurers, from providing transportation, shipment or financial services related to sanctioned goods.<\/p>\n\n\n\n

The Baltic states are not making concessions to the United States regarding the transit of Belarusian potash through their territory, Deividas Matulionis, national security advisor to the Lithuanian president, said earlier this month.<\/p>\n\n\n\n

\u200bThe official added that the US is also discussing this topic with other countries in the region, \u201cbut so far we are all standing together, and I see no concessions either from our side or from other neighboring countries.\u201d<\/p>\n\n\n\n

Minsk and Washington have been discussing possible potash exports to the US as part of their talks that have resulted in the release of hundreds of Belarusian political prisoners and the removal of some US sanctions against Belarus.<\/p>\n\n\n\n
