September 18, Pozirk.<\/em><\/strong> The European Court of Justice has rejected claims to lift sanctions, filed by the Bie\u0142aru\u015bkalij potash miner, its CEO Ivan Ha\u0142avaty and the Belarusian Potash Company (BPC).<\/p>\n\n\n\n

According to the court website, Bie\u0142aru\u015bkalij, the BPC and Ha\u0142avaty support the regime of Alaksandar \u0141uka\u0161enka, benefit from it and are involved in reprisals.<\/p>\n\n\n\n

The plaintiffs tried to challenge these assertions and sought to be excluded from EU sanctions lists, but the court did not find their arguments convincing.<\/p>\n\n\n\n

According to the rulings, Bie\u0142aru\u015bkalij is a key source of income for the \u0141uka\u0161enka regime. The state gave the company monopoly rights to export potash fertilizers. As a result of the preferential treatment, the plaintiff received significant income and therefore benefited from the \u0141uka\u0161enka regime and supported it.<\/p>\n\n\n\n

The arguments for keeping the BPC, an export division of the state-owned potash miner, on the sanctions lists are similar.<\/p>\n\n\n\n

Sanctions against Ha\u0142avaty were upheld because he is considered to be linked to \u0141uka\u0161enka and his family members and responsible for political reprisals at the company.<\/p>\n\n\n\n

The court ordered the plaintiffs to cover litigation costs.<\/p>\n\n\n\n

The EU included Ha\u0142avaty, Bie\u0142aru\u015bkalij and the BPC in its sixth sanctions package in June 2022. In December 2023, the European Court of Justice ruled to dismiss a lawsuit by a Bie\u0142aru\u015bkali-linked bulk cargo terminal in Lithuania’s Klaip\u0117da against the Council of the European Union.<\/p>\n\n\n\n

In February 2023, the Council had renewed and extended sanctions on Belarus, banning the movement of potash fertilizers from the country across the EU. The BKT terminal challenged the ban in court.<\/p>\n\n\n\n
